Whether certain payments to current firefighters are “basic salary” for purposes of calculating pensions under RCW 41.18. An increase in salary generally payable to all current firefighters, such as additional payment to all firefighters for qualifying as Emergency Medical Technicians (EMTs), is “basic salary” for purposes of calculating the pensions of firefighters retired under RCW 41.18; by contrast, employer contributions to a deferred compensation plan would not meet the “basic salary” definition of the same statute.

PENSIONS - LAW ENFORCEMENT OFFICERS' AND FIRE FIGHTERS' RETIREMENT SYSTEM - GROUP HOSPITALIZATION AND MEDICAL AID INSURANCE (1) The requirement that a county or other political subdivision providing its employees with hospital and medical aid coverage under RCW 41.04.180 must offer a choice of policies or plans through not less than two carriers is not impliedly repealed by RCW 41.26.150 (4), as amended by § 10, chapter 6, Laws of 1970.(2) When a county or other municipality, acting as an "employer" under the provisions of the Washington law enforcement officers' and fire fighters' retirement act, is providing medical insurance coverage for those of its employees or retired former employees who are, or were, members of this retirement system as provided for in RCW 41.26.150 (4), it is not required to offer a choice between two or more insurance plans but it may, in its discretion, do so.

PENSIONS - LAW ENFORCEMENT OFFICERS AND FIREFIGHTERS - COSTS OF OPERATION OF COUNTY DISABILITY BOARD - MEDICAL COVERAGE - COUNTY CURRENT EXPENSE FUND (1) The costs of operation of a county disability board established pursuant to RCW 41.26.110 (2), including the costs of medical examinations of applicants for disability retirement allowances under RCW 41.26.120 (1), are to be paid out of the county current expense fund.(2) A board of county commissioners may authorize the expenditure of monies in its current expense fund to meet the costs of operation of a county disability board during the current fiscal year on the basis of the procedures set forth in RCW 36.40.180 relating to nondebatable emergencies.(3) A county disability board is not authorized or required under RCW 41.26.150 (1) to determine what medical insurance coverage should be provided by each employer under its jurisdiction with respect to the law enforcement officers and firefighters employed by each such employer.(4) A county disability board is required to designate the hospital and medical services which are to be available to a sick or disabled law enforcement officer or firefighter under its jurisdiction; and it is authorized to determine his physical condition for the purpose of ascertaining the nature and extent of his sickness or disability.

PENSIONS - POLICE OFFICER - WASHINGTON LAW ENFORCEMENT OFFICERS' AND FIREFIGHTERS' RETIREMENT SYSTEM - ELIGIBILITY A police officer who was employed by a first class city on March 1, 1970, and who was making contributions to a retirement system as provided in chapter 41.20 RCW, is entitled to have his eligibility for retirement benefits under that chapter determined by the provisions thereof notwithstanding the fact that, on March 1, 1970, his membership was transferred, by operation of law, from the former retirement system to the law enforcement officers' and firefighters' retirement system, chapter 41.26 RCW.

Effect of “non-contractual rights clause” on Legislature’s future obligation to provide “gain-sharing benefits” Where the Legislature has enacted statutes providing “gain-sharing” benefits to retirement system members if certain circumstances occur, but has included language reserving the right to repeal or modify such benefits before they are actually granted, pension system members have no enforceable right or current reasonable expectation of receiving such benefits.

DISTRICTS - SCHOOLS - PENSIONS - PUBLIC WORKS
PENSION PROGRAM FOR NONCERTIFICATED SCHOOL DISTRICT EMPLOYEES (1) RCW 41.40.410, as amended by § 1, chapter 84, Laws of 1965, requires all public school districts to provide coverage in the Washington public employees' retirement system for their eligible noncertificated employees even though such employees may be members of a craft or trade union which has its own union pension trust plan; the fact of membership in such a craft or trade union does not constitute a basis for personal ineligibility for membership in the public employees' retirement system under the provisions of RCW 41.40.120.(2) Chapter 39.12 RCW, providing for payment of the "prevailing rate of wage" (including pension benefits, where applicable) on public works projects does not apply when a school district directly hires noncertificated craft or trade union members on a regular basis to perform work on school district property under the supervision of the school district administrators.(3) A school district which is covering its noncertificated employees under the Washington public employees' retirement system is not authorized to make additional pension contributions to a union pension trust fund set up by a craft or trade union to which these employees belong.

PENSIONS - DISABILITY LEAVE - DISABILITY RETIREMENT
WASHINGTON LAW ENFORCEMENT OFFICERS' AND FIRE FIGHTERS' RETIREMENT SYSTEM (1) A local disability board may allow a member of the retirement system who has previously been granted a disability leave, to return to duty on a conditional basis and for a limited period of time as a method of determining whether he is unable to continue his service within the meaning of RCW 41.26.120, where the existence or nonexistence of a continuing disability has not been conclusively established to the satisfaction of the board by a medical examination.(2) Such a conditional return to duty does not entitle the member to a second six-month period of disability leave for the same disability if, based upon this trial period of service, he is then found still to be disabled; if this should occur, disability retirement is the proper benefit to be granted.

WASHINGTON LAW ENFORCEMENT OFFICERS' AND FIRE FIGHTERS' RETIREMENT SYSTEM Monies in a city's paid firemen's pension fund established pursuant to RCW 41.16.050 may not be used to fund employers' contributions to the Washington law enforcement officers' and fire fighters' retirement system as required by RCW 41.26.080, or to pay disability leave allowances as provided for in RCW 41.26.110; however, such monies may be used to pay for the costs of hospitalization and other medical expenses incurred by fire fighters covered by the law enforcement officers' and fire fighters' retirement system, and payable by their employers under RCW 41.26.150.

RETIREMENT - PENSIONS - TEACHERS - STATE EMPLOYEES
RETENTION OF MEMBERSHIP IN TEACHERS' RETIREMENT SYSTEM OR TRANSFER TO PUBLIC EMPLOYEES' RETIREMENT SYSTEM UPON CHANGE IN EMPLOYMENT STATUS (1) A person who has properly established membership in the Washington Teachers' Retirement System (TRS) through employment as a public school teacher in accordance with RCW 41.32.240 or RCW 41.32.780 may thereafter continue to participate in TRS and receive TRS service credit in connection with later periods of employment with the same or another school district or a state agency even though that person is not still employed as a teacher. (2) Such continuing active participation in the Washington Teachers' Retirement System, however, is only permitted and not required under the specified circumstances; accordingly, the person in question (by not returning to or continuing in active TRS membership upon his or her change in employment status) may, if employed in an eligible position under the Washington Public Employees' Retirement System (PERS), thereafter be covered as a member of that retirement system unless he or she is personally ineligible, under RCW 41.40.120, for some other reason.

FIREMEN ‑- PENSIONS ‑- DISABILITY ‑- FIRE PROTECTION DISTRICTS ‑- MEDICAL BENEFITS 1.  The obligation imposed by RCW 41.18.060 to provide medical care for a fireman who has been disabled cannot be fulfilled by the purchase of a medical insurance policy.  2.   The Firemen's Pension Board established pursuant to RCW 41.18.015 may exercise some discretion in specifying authorized care providers if it does so through properly established procedures.

RETIREMENT - PENSIONS - LEOFF RETIREMENT SYSTEM - DRUGS AND MEDICINE
MEDICAL SERVICES UNDER RCW 41.26.150 (1) In the case of a LEOFF Retirement System member seeking payment for medical services, an employer under chapter 41.26 RCW may be required to pay for drugs prescribed by a physician for the member regardless of whether or not the drug prescribed is one which can be legally purchased without a physician's prescription.(2) Syringes used to inject insulin do not constitute "drugs and medicine" under RCW 41.26.030(22)(b)(iii)(A).(3) It is a function of a LEOFF Disability Board established under RCW 41.26.110 not only to designate what medical services are to be provided to a sick or disabled member but, in addition, to designate the provider of medical services under RCW 41.26.150.

PENSIONS - RETIREMENT - INITIATIVE NO. 62
IMPACT ON PROPOSED PENSION LEGISLATION (1) In the event that the legislature amends the statutes governing the Public Employees' Retirement System (PERS) by increasing post-retirement benefits in such a manner as will require all employers, including local taxing districts, to make increased employer contributions to the retirement system, the provisions of section 6(1) of Initiative 62 will not require the state to reimburse those taxing districts for such increased contributions.(2) If the legislature amends the statutes governing the Teachers' Retirement System (TRS) in such a manner as to require that local school districts make some form of "employers' contribution" to the system, the provisions of section 6(1) of Initiative 62 will likewise not require the state to reimburse those local school districts for such contributions; however, such legislation could cause section 6(3) of the initiative to become applicable unless the full cost to the school district resulting from the legislation is, in turn, covered by state funding in accordance with Wash. Const., Art. IX, section 1.(3) If the legislature acts to require that persons seeking to be employed as municipal fire fighters or law enforcement officers meet minimum medical and health standards in order to become eligible for such employment, and the taxing districts by which those personnel are employed thereby incur additional costs either in establishing or implementing such standards, the state will not be required by section 6(1) of Initiative 62 to reimburse those taxing districts for such costs.

PENSIONS ‑- RETIREMENT ‑- FIREMEN ‑- LAW ENFORCEMENT OFFICERS' AND FIRE FIGHTERS' RETIREMENT SYSTEM (1) It is not necessary that a fire dispatcher pass a civil service examination for firemen or fire fighters in order to be considered a "fire fighter" as that term is used in chapter 41.26 RCW, the law enforcement officers' and fire fighters' retirement system; instead, it is sufficient that a person has been serving on a full-time, fully compensated basis as a fire dispatcher in a city, town or other municipal fire department which, on March 1, 1970, required its dispatchers to have passed a civil service examination for fireman or fire fighter ‑ without regard to whether the particular individual has, himself, taken or passed such an examination.(2) Any person who, on March 1, 1970, was employed in a fulltime, fully compensated basis by an employer covered by the law enforcement officers' and fire fighters' retirement system, and who, on May 21, 1971, was making contributions under the provisions of chapters 41.16 or 41.18 RCW, is also now to be considered a "fire fighter" for the purposes of chapter 41.26 RCW, whether or not he has taken or passed a civil service examination for fire fighters or firemen.(3) A retired fireman is entitled to the increased benefits provided by RCW 41.16.145 or RCW 41.18.104, as clarified by §§ 17 and 18 of chapter 257, Laws of 1971, 1st Ex. Sess., if he was retired for disability under either of those two chapters and was so retired prior to June 8, 1961.(4) A fire fighter who has vested under RCW 41.18.130 is not required to have attained the age of 50 years before being entitled to receive an allowance under that statute.

PENSIONS - FIREMEN - COVERAGE UNDER CHAPTER 255, LAWS OF 1961
PENSIONS ‑- FIREMEN ‑- COVERAGE UNDER CHAPTER 255, LAWS OF 1961 (1) A fireman who has made contributions under prior act and desires to avail himself of the benefits of chapter 255, Laws of 1961, must manifest his election by filing a written notice with the board within sixty days from June 8, 1961.(2) Such a fireman must return any refunds previously received by reason of selecting the benefits of prior acts before becoming entitled to the benefits provided by chapter 255, Laws of 1961, but such return of refunds need not be accomplished within sixty days after June 8, 1961.(3) A fireman who has received prior refunds cannot elect to come under the 1961 act without returning in full the amount of such refunds.(4) The return of refunds above described is to be made to the appropriate local firemen's pension board and a contract can be made between the fireman and the board for the payment of required refunds over a period of time; but until a complete return of such refunds is accomplished, the fireman in question will not be covered by the new act.(5) With the exception of those pre‑1947 (i.e., "prior") firemen who affirmatively elected, pursuant to chapter 382, Laws of 1955, to remain under the pre‑1947 pension system, firemen whose employment commenced prior to January 1, 1947, should be treated as being covered by chapter 382, Laws of 1955, and thereby required to contribute to the firemen's pension fund the salary percentages called for by that 1955 act rather than the lesser percentage called for by § 4, chapter 39, Laws of 1935.(6) A claim for refund of the overcontributions resulting from a mistake of law as to the applicability of chapter 91, Laws of 1947, would come within the three‑year statute of limitations.(7) Where a pre‑1947 (i.e., "prior") fireman pursuant to § 17, chapter 382, Laws of 1955, has elected to remain a member of the pre‑1947 pension system, his recovery of overcontributions due to a mistake of law is a refund by reason of selection of the benefits of prior acts and consequently, such overcontributions as have been thus recovered are returnable as a condition precedent to coverage under the new 1961 act if an election to be so covered is made.(8) A fireman whose employment commenced prior to January 1, 1947, is a member of the 1955 pension system in the absence of an affirmative election to the contrary.  If an election to come into the 1947 [[Orig. Op. Page 2]]or 1955 system has been made by a particular prior fireman, such fireman cannot now elect to return to the pre‑1947 pension system.

LAW ENFORCEMENT OFFICERS' AND FIRE FIGHTERS' RETIREMENT SYSTEM ‑- MEMBERSHIP ON LOCAL DISABILITY BOARD (1)  A municipal fire fighter or law enforcement officer who was first employed as such on or after October 1, 1977, and thus is classified as a Plan II member of the Law Enforcement Officers and Fire Fighters Retirement System (LEOFF), may nevertheless be elected to, and serve as a member of, a local LEOFF disability board established pursuant to RCW 41.26.110.(2)  Likewise, a municipal fire fighter or law enforcement officer who is a Plan II LEOFF member may vote for the fire fighter or law enforcement officer position on a city disability board under RCW 41.26.110(a); but such a Plan II fire fighter or law enforcement officer may not do so in the case of a county disability board under RCW 41.26.110(b).

Sess. or § 2, chapter 10, Laws of 1982, 1st Ex. Sess. relating to employer liability for increased retirement benefit costs under the laws governing the Public Employees' Retirement System and the State Teachers' Retirement System, respectively.

WITHDRAWAL BY INDIVIDUAL DISTRICTS Because of the necessity for a legally sufficient description in connection with an offer to sell, or sale of, real property an offer to sell a portion of a larger tract of land, or the execution of a purchase and sale agreement covering such a tract of land, constitutes a "division" of the land under the definition of a "short subdivision" contained in RCW 58.17.020(6) or (7) so as to render applicable the various provisions of chapter 58.17 RCW relating to short plats and short subdivisions.

DIVISION OF INSURANCE COSTS Medical insurance for law enforcement officers or firefighters under RCW 41.26.150(4), on the basis of which medical service payments by the employer are to be reduced in accordance with subsection (2) of that statute, may be paid for entirely by the employer or partially by the employer and partially by the subject employees; an employer may not, however, require its employees to pay the entire cost of such plan or plans of group hospitalization and medical aid insurance.

Sess., establishing a $300 per month minimum with respect to the pensions payable to certain retired municipal firemen and law enforcement officers and their survivors, this figure now constitutes the minimum basis to be used in computing the annual two percent cost of living pension increases provided for in RCW 41.16.145, RCW 41.18.104, and RCW 41.26.250.

PENSIONS ‑- FIREMEN ‑- CITIES AND TOWNS ‑- USE OF MILLAGE LEVY ‑- DEFINITION OF ACTUARY ‑- FUND CONSIDERED ACTUARIALLY SOUND (1) Under the provisions of § 9, chapter 255, Laws of 1961, if after an examination of and report on the condition of the firemen's pension fund by an actuary, it is determined that the condition of the fund is such as not to require all or part of the millage levy therein provided for, such millage may be omitted or levied and used for other municipal purposes. (2) The word "actuary" as used in RCW 41.16.060 means the computing officer of an insurance company; a person skilled in calculating the value of life interests, annuities, and insurance.  Whether or not an individual qualifies as an actuary is a question of fact since there is no legal provision in this state for crediting or qualifying an actuary for the purposes of RCW 41.16.060. (3) and (4) Examination and report of an actuary specified by RCW 41.16.060 contemplates an examination and report as to the actuarial soundness of the firemen's pension fund; not merely the anticipated cash disbursements or operating expenses of the fund for an ensuing fiscal year.

RETIREMENT ‑- PENSIONS ‑- SALARIES AND WAGES ‑- COMPENSATION ‑- INCLUSION OF TERMINAL LEAVE OR SEVERANCE PAY IN COMPUTING PENSIONS OR RETIREMENT ALLOWANCES (1) Terminal leave or severance payments for unused sick leave or vacation leave are not to be included in determining the salary or compensation base upon which retirement allowances or pensions are to be computed under the laws governing the Washington law enforcement officers' and firefighters' retirement system (chapter 41.26 RCW) or either of the two judicial retirement systems (chapters 2.10 and 2.12 RCW); however, such payments are to be included in determining the salary or compensation base upon which retirement allowances or pensions are to be computed under the laws governing the Washington public employees' retirement system (chapter 41.40 RCW), the Washington state teachers' retirement system (chapter 41.32 RCW) and the Washington state patrol retirement system (chapter 43.43 RCW).  (2) Where terminal leave or severance payments for unused sick leave or vacation leave are to be included in determining the salary or compensation base upon which retirement allowances or pensions are to be computed, the only such payments thus to be included are those reflecting such leave actually earned but not taken during the time period being utilized in each case to determine the appropriate salary or compensation base.

SCOPE OF MEDICAL SERVICES (1) The phrase "his teeth" in RCW 41.26.030 (relating to members of the Washington Law Enforcement Officers and Fire Fighters Retirement System) includes not only natural teeth but also previously installed dental work such as bridges, false teeth, fillings, and the like. (2) The obligation of an employer, under RCW 41.26.150, to pay for dental repair or replacement for an individual whose previous dental work broke while eating depends on whether, under the facts of the particular case as determined by the disability board having jurisdiction, the damages were the result of an accident.

RETIREMENT ‑- PENSIONS ‑- LAW ENFORCEMENT OFFICERS' AND FIRE FIGHTERS' RETIREMENT SYSTEM ‑- COMPUTATION OF DISABILITY LEAVE AND DISABILITY RETIREMENT ALLOWANCES (1) Where a Plan I member of the Law Enforcement Officers' and Fire Fighters' Retirement System has been placed on disability leave under RCW 41.26.120, his disability leave allowance is not affected by salary increases (or decreases) granted to active members of the police or fire department during the period he remains on disability leave.   (2) The disability retirement allowance payable to a Plan I member of the Law Enforcement Officers' and Fire Fighters' Retirement System under RCW 41.26.130 is to be based on his salary at the time he began his period of disability leave.

IMPACT ON PROPOSED PENSION LEGISLATION If the Legislature amends the statutes governing the Law Enforcement Officers' and Fire Fighters' Retirement System, Plan II (LEOFF II), by reducing the retirement age from 58 years to 50 years, reducing the number of months of service from 60 months to 24 months in determining the final average salary, and requiring any increased costs to be borne by local taxing districts/employers, the State would not be required by RCW 43.135.060(1) to reimburse those local taxing districts.

Change in Pension of Retired Member RCW 41.20.050 and .060 provide that a retired police officer will receive a pension equal to 50 percent of the amount of salary at any time attached to the position held at the date of retirement.  If a city creates a new step in its civil service classification and advances all officers at the next lower step to the new step, an officer who retired at that next lower step will receive a pension equal to 50 percent of the salary attached to the new step.

(2) Where a paid fireman is disabled as a result of an injury incurred while in the performance of his duties as a fireman, (a) if coverage is under chapter 41.16 RCW, the municipal pension board is required to provide medical, hospital and nursing care in connection with the disability for such period as the board deems proper; (b) if coverage is under chapter 41.18 RCW, the municipal pension board is required to provide medical, hospital and nursing care in connection with the disability as long as the disability exists; (c) however, in neither case should the board be regarded as liable for any and all medical, hospital and nursing costs incurred by the disabled fireman without regard to whether the fireman has made a prior application and received prior approval in accordance with established procedures.

The annual post-retirement pension increase payable to the widow of a municipal fireman covered under the provisions of chapter 41.18 RCW at the time of his death in line of duty or following retirement for service connected disability, but who was still living and in service on July 1, 1969, when chapter 209, Laws of 1969, Ex. Sess., became effective, will be governed by the provisions of § 28 of that act, to the end that her annual two percent pension increases will be effective with each January pension payment she receives under that section.

Sess., a first-class city police officer's service retirement allowance may not be based upon the salary of a position higher than that of captain in the absence of an election to that effect made on or before September 1, 1969.

COMPUTATION OF CERTAIN DISABILITY RETIREMENT BENEFITS Where a municipal fireman otherwise eligible for a disability retirement allowance under the provisions of RCW 41.18.060 was, at the time of retirement, holding a rank or receiving a salary in excess of that of a battalion chief, he is not thereby precluded from receiving the additional increments in such allowance that are payable under that statute by reason of years of service in excess of twenty-five years.

CALCULATION OF DISABILITY RETIREMENT BENEFITS When a former member of the state‑wide [[statewide]]city employees' retirement system who transferred to the public employees' retirement system under chapter 75, Laws of 1971, is awarded disability retirement benefits calculated pursuant to chapter 41.44 RCW, those retirement benefits are not to be offset by amounts received from the department of labor and industries on account of the same disability.
