Dear Sir:

We acknowledge receipt of your letter dated April 13, 1970, requesting our opinion as to the monetary jurisdiction of a district justice court judge operating under the provisions of the 1961 justice court act.

                                                                     ANALYSIS

In the enclosure to your letter, reference is made to AGO 65-66 No. 23 [[to Prosecuting Attorney, Snohomish County on June 14, 1965]], copy enclosed.  However, this opinion has no application to a district justice court judge in a county which has adopted the provisions of the 1961 justice court act ‑ chapter 299, Laws of 1961; instead, this opinion, which construes the provisions of RCW 3.20.020, pertains only to the monetary jurisdiction of a part-time justice of the peace in a justice court not operating under the provisions of the 1961 act.

In the case of a district justice court judge in a county which has adopted the provisions of the 1961 justice court system, the applicable statute with respect to the monetary jurisdiction is RCW 3.66.020.  Accord, our letter dated February 7, 1967, to the Honorable Chas. H. Clemons, Justice of the Peace, copy enclosed.

It is hoped that the foregoing will be of assistance to you.

Very truly yours,

FOR THE ATTORNEY GENERAL

Philip H. Austin
Assistant Attorney General
