Dear Sir:

We acknowledge receipt of your recent letter requesting our opinion on a question pertaining to the date for an election to fill certain vacancies on the school board of the Arlington School District ‑ which positions are presently held by appointees of the intermediate school board having jurisdiction as specified in RCW 28.63.020.

                                                                     ANALYSIS

In response we are enclosing herewith a copy of our recent opinion to State Representative R. Ted Bottiger, dated April 14, 1970, passing upon a similar question with respect to port district commissioners.  We believe that the reasoning utilized in this opinion to Representative Bottiger is equally applicable to the school district situation which you have described.  In accordance with this reasoning, it is our opinion that the positions of the school board in question are to be filled at the November, 1971 school district election.

We trust that the foregoing will be of assistance to you.

Very truly yours,

FOR THE ATTORNEY GENERAL

Philip . Austin
Assistant Attorney General
