AGO 1981 NO. 2 >

(1) Under RCW 46.10.110, a board of county commissioners (as the responsible governing body in the case of county roads) may open to snowmobiles a county road which is also open to conventional vehicles.(2) Neither the provisions of chapter 46.16 RCW nor those of chapter 46.37 RCW apply to snowmobiles, even when operated on a public highway or roadway which is also open to conventional vehicles.(3) A county may not establish equipment standards or impose age qualifications for the operation of snowmobiles which are inconsistent with RCW 46.10.090 or RCW 46.10.120, respectively.

RCW 35.02.220 does prohibit a county from discontinuing construction or repair of county roads which lie within the boundaries of a proposed city or town, prior to the official date of incorporation, for the reason that incorporation has been approved by the voters.

The duty and liability of a county to maintain a county road once a part of a county road system cannot be divested by mere resolution.

AGO 1952 NO. 425 >

The grant of one franchise to the P.U.D., to replace all existing franchises on county roads, complies with the description in the notice required to be published and posted pursuant to RCW 36.55.040 where said description reads:  "all county roads in the County of Grays Harbor."
