Other LanguagesUnless modified by regulations promulgated by the governor under RCW 42.18.270, a "thing of economic value" as defined in RCW 42.18.140, prohibiting certain gifts to state employees, includes even those items of tangible personal property which are of minimal monetary value.
1. A water district commissioner is a municipal officer subject to the Code of Ethics for Municipal Officers, chapter 42.23 RCW. Under RCW 42.23.030 a water district commissioner cannot have a beneficial interest in a contract with the district where the water district's total liability exceeds $750 in any calendar month. 2. A part-time employee, operating under the control of a board of water commissioners is not a municipal officer subject to the Code of Ethics for Municipal Officers. Thus, the restrictions in RCW 42.23.030 do not apply to the part-time employee.
Membership in the State Investment Board includes the State Treasurer and one member each of the House of Representatives and the Senate. Members of the Board are subject to the Executive Conflict of Interest Act, chapter 42.18 RCW. Although the Act does not apply to elected state officers and legislators when they are acting in their capacity as elected officials, these elected officials are subject to the Act when they are acting in their capacity as a member of the Board.
(1) and (2) Chapter 42.23 RCW and specifically RCW 42.23.020 prohibits the employment of either a school director or his wife for compensation except as specifically provided in the act. (3) A proviso of RCW 42.23.030 allows the employment of a school director or his wife in school districts other than districts of the first class, up to certain maximum amounts, ($200) which amount is measured by the total liability of the district under the contract or contracts at the time they are executed and not by the size of monthly installments into which the contract may be divided for subsequent payment. (4) No individual may be employed by a school district as a teacher, whether on a full-time, part-time, or "substitute" basis, unless such individual has a valid teacher's certificate as required by § 1, Article VII, subchapter 4, chapter 97, Laws of 1909 (cf. RCW 28.67.010).
