WASHINGTON STATE APPLE COMMISSION ‑- POWER TO EXPEND MONEY TO ENLARGE OFFICE SPACE

The Washington State Apple Commission is authorized to expend funds to enlarge their office facilities.

Dear Sir:

            This is to acknowledge your letter of June 25, 1951, in which you ask whether the Commission was authorized to make a capital expenditure to improve and enlarge the Commission's office facilities.

            Our answer is in the affirmative.

                                                                     ANALYSIS

            Section 8, chapter 195, Laws of 1937 (Rem. Supp. § 2874-8; RCW 15.24.070), provides in part:

            "The powers of the commission include:

            "* * *

            "(4) To establish offices and incur expense and enter into contracts * * *"

            We feel that the above section is broad enough to authorize the Commission to make an expenditure to enlarge their office facilities.  We do not feel that the words "to establish offices" was meant to be restrictive but rather was  [[Orig. Op. Page 2]] intended to mean that the Commission could not only establish offices but could spend money to maintain them which, if necessary, would include enlarging the existing facilities.
