AGLO 1974 NO. 46 >

(1) A police officer may employ the services of a commercial towing truck to move a parked automobile from a highway under RCW 46.61.565. (2) In such a case, the tow truck operator will have a statutory lien against the owner of the automobile for payment of his charges, and will also have a contractual right to payment by the county or city which retained his services if the vehicle involved later turns out to have been abandoned and is not claimed by its owner.

A sheriff may not, under the 13th paragraph of RCW 36.18.040, charge mileage fees for an unsuccessful attempt to serve an individual in addition to mileage fees charged on a second trip when service was successfully made.

The commissioners of a county may not grant a leave of absence to the sheriff for the purpose of enabling the sheriff to accept employment with the United States government in a different locality, and appoint an acting sheriff in his stead.  In the event the sheriff shall take a leave of absence of his own volition; his salary may not be terminated during such leave.   Possible recourse against the sheriff may be had under RCW 42.12.010.
